PRIVACY NOTICE – COLEKTIA MÉXICO, S.A.P.I. DE C.V.

In compliance with applicable Mexican legislation on the protection of personal data, including the Federal Law on the Protection of Personal Data Held by Private Parties and its current regulatory provisions, COLEKTIA MÉXICO, S.A.P.I. DE C.V. (“COLEKTIA” or the “Company”), located at Av. Insurgentes Sur 664, 6th Floor, Col del Valle Nte, Benito Juárez, 03103 Mexico City, informs Users, Clients, Employees, and Suppliers about the processing of their personal data pursuant to this Privacy Notice. The department responsible for compliance with this Notice and the exercise of ARCO rights is the Personal Data Protection and Compliance Department, available at privacidad@colektia.com.

I. PURPOSES OF DATA PROCESSING

a) Website Users

The data provided by Users will be used to provide information about COLEKTIA's services, manage inquiries, enable communication, and maintain a record of digital interactions. Likewise, it may be used for administrative and advertising activities, or for sending promotions and offers. In case of disagreement with secondary purposes, the User may exercise their right in accordance with Section VIII.

b) Clients

The data provided by Clients will be used to execute extrajudicial collection activities, generate and manage debtor databases, manage files, conduct internal analysis, maintain operational communication, perform investigations and locations, and carry out other activities derived from the existing contractual relationship. The information may be disclosed to third parties related to the original obligation and to COLEKTIA's operational or administrative staff. Additionally, it may be used for client or debtor identification, advertising purposes, or internal administrative activities, unless the Client expressly refuses in accordance with Section VIII.

c) Employees

The personal data of Employees will be used to manage the employment relationship, execute recruitment processes, hiring, training, regulatory compliance, internal security, and corporate communication.

d) Suppliers

The personal data of Suppliers will be used for managing administrative files, operational validation, commercial control, invoicing, and fulfillment of the service provision agreement.

II. PERSONAL DATA COLLECTED

COLEKTIA may obtain personal data through physical or digital forms, telephone calls, WhatsApp, SMS, email, web interactions, or any other means of contact.

Users may provide name, email address, telephone number, company, country, and contact information.

Clients may provide name, address, RFC, CURP, email address, telephone number, marital status, financial information, credit data, and debtor data.

Employees may provide name, address, marital status, RFC, CURP, employment history, and administrative and banking data.

Suppliers may provide name, company name, RFC, address, billing data, and contact details.

The debtor data provided by Clients will be processed exclusively for extrajudicial collection purposes, in accordance with current Mexican legislation and the existing legal relationship between the Client and the debtor.

III. SOCIAL MEDIA

The processing of data derived from interactions with official social media accounts of COLEKTIA is governed by the terms and policies of each respective platform. COLEKTIA does not control the data that these platforms collect directly from the User.

IV. PROTECTION AND SECURITY MEASURES

COLEKTIA will process personal data in accordance with the principles of legality, consent, information, quality, purpose, loyalty, proportionality, and responsibility established in Mexican legislation. Furthermore, it will implement administrative, technical, and physical measures aligned with ISO 27001 and ISO 9001 standards, including access controls, encryption, incident monitoring, security protocols, traceability, periodic audits, operational continuity, and recovery plans.

V. DATA TRANSFER

Personal data may be communicated to related entities of the COLEKTIA Group within and outside of Mexico, to Clients who require debtor information for collection efforts or legal actions, to technology providers that render services to COLEKTIA, to administrative or judicial authorities, and to third parties related to the Client's original obligation. All transfers will be carried out in accordance with applicable Mexican legislation and solely for the purposes stated herein.

VI. USE OF COOKIES AND SIMILAR TECHNOLOGIES

COLEKTIA's website uses cookies, pixel tags, and similar technologies to improve User experience, perform statistical analysis, and offer personalized services. The User may delete or restrict cookies through their browser settings, understanding that this could affect certain website functionalities.

VII. OPTIONS AND MEANS TO LIMIT THE USE OR DISCLOSURE

Data Subjects may request to limit the use or disclosure of their data through the procedure set forth in Section VIII, including enrollment in internal exclusion lists or restrictions for secondary purposes.

VIII. ARCO RIGHTS AND MECHANISMS FOR THEIR EXERCISE

Data Subjects may exercise their rights of Access, Rectification, Cancellation, and Opposition (ARCO rights), as well as request the limitation of data use or the revocation of their consent by sending a written request to privacidad@colektia.com. The request must include full name, identity document, means of contact, clear description of the right being exercised, and documents proving their identity. COLEKTIA will respond within the timeframes provided by Mexican legislation. If the Data Subject considers that their rights have been violated, they may turn to the National Institute for Transparency, Access to Information and Personal Data Protection (INAI).

IX. AMENDMENTS TO THE NOTICE

COLEKTIA may modify this Notice to reflect legal, technological, or operational changes. Amendments will be published on the official website and will take effect upon publication.

X. CONSENT

The Data Subject acknowledges that they have read and understood this Privacy Notice. The use of COLEKTIA's services, the submission of personal data, or communication with the company constitutes consent to the data processing described herein, in accordance with current Mexican legislation.

In compliance with current Chilean regulations on the protection of personal data, including Law No. 19,628 on the Protection of Private Life and other applicable regulatory provisions, COLEKTIA CHILE SpA (“COLEKTIA” or the “Company”), located at Av. Providencia 1208, Oficina 2101, Providencia, Chile, hereby informs Users, Customers, Employees, and Suppliers about the processing of their personal data pursuant to this Privacy Notice. The department responsible for compliance with this Notice and handling rights requests is the Personal Data Protection and Compliance Department, available at privacidad@colektia.com.

Data may be disclosed to third parties related to the original obligation and to COLEKTIA's operational or administrative staff. Additionally, it may be used for customer or debtor identification, advertising purposes, or internal administrative activities, unless the Customer expresses their refusal in accordance with Section VIII.

c) Employees

The personal data of Employees will be used to manage the employment relationship, recruitment processes, hiring, training, regulatory compliance, internal security, and corporate communication.

d) Suppliers

The personal data of Suppliers will be used for managing administrative files, operational validation, commercial control, invoicing, and fulfillment of the service provision agreement.

⚠️ Note on Debtor Data: Debtor data provided by Customers will be processed solely for extrajudicial collection purposes, in accordance with current Chilean regulations and the legal relationship between the Customer and the debtor.

All communication will be carried out in accordance with Law No. 19,628 and solely for the purposes stated in this Notice.

Data Subjects may request to limit the use or disclosure of their data, including restrictions for secondary purposes or inclusion in internal exclusion lists, in accordance with the procedure set forth in Section VIII.

COLEKTIA will respond within the legal timeframes. If the Data Subject considers that their rights have been violated, they may turn to the competent authority in Chile.

(“COLEKTIA” or the “Company”), located at Jirón Ocoña Nº 160, Cercado de Lima, province and department of Lima, informs Users, Clients, Employees, and Suppliers about the processing of their personal data pursuant to this Privacy Notice. The department responsible for compliance with this Notice and handling ARCO-P rights requests is the Personal Data Protection and Compliance Department, available at privacidad@colektia.com.

Additionally, it may be used to identify clients and debtors, for advertising purposes, or internal administrative activities, unless the Client expresses their refusal in accordance with Section VIII.

c) Employees

The personal data of Employees will be used to manage the employment relationship, execute recruitment processes, hiring, training, regulatory compliance, internal security, and corporate communication.

d) Suppliers

The personal data of Suppliers will be used for managing administrative files, operational validation, commercial control, invoicing, and fulfillment of the service provision agreement.

The debtor data provided by Clients will be processed exclusively for extrajudicial collection purposes, in accordance with current Peruvian legislation and the existing legal relationship between the Client and the debtor.

Personal data may be communicated to related entities of the COLEKTIA Group within and outside of Peru, to Clients who require debtor information for collection efforts or legal actions, to technology providers, to administrative or judicial authorities in accordance with the law, and to third parties related to the Client's original obligation. All national or international transfers will be carried out in accordance with Law 29733, its regulatory provisions, and the principles of purpose and proportionality.

Data Subjects may exercise their rights of Access, Rectification, Cancellation, and Opposition, as well as the rights to Information, Inclusion, Deletion, and Revocation of consent, by sending a request to privacidad@colektia.com. The request must include full name, DNI, means of contact, description of the right being exercised, and documents proving identity. COLEKTIA will respond within the timeframes established by Peruvian regulations. If the Data Subject considers that their rights have been violated, they may turn to the National Authority for Personal Data Protection of the Ministry of Justice and Human Rights.

X. CONSENT

En cumplimiento del régimen colombiano de protección de datos personales, incluyendo la Ley 1581 de 2012 y su normativa reglamentaria vigente, COLEKTIA COLOMBIA S.A.S. (“COLEKTIA” o la “Sociedad”), con domicilio en KR 18 A 103 11BOGOTA D.C. BOGOTA D.C., informa a Usuarios, Clientes, Trabajadores y Proveedores sobre el tratamiento de sus datos personales conforme al presente Aviso de Privacidad. El área responsable del cumplimiento de este Aviso y de la atención de solicitudes sobre habeas data es el Área de Cumplimiento y Protección de Datos Personales, disponible en privacidad@colektia.com.

I. FINALIDADES DEL TRATAMIENTO

a) Usuarios del sitio web

Los datos proporcionados por Usuarios serán utilizados para brindar información sobre los servicios de COLEKTIA, gestionar consultas, habilitar comunicación y mantener registro de interacciones digitales. Asimismo, podrán emplearse para actividades publicitarias, administrativas o para el envío de promociones u ofertas. Si el Usuario no desea el tratamiento para finalidades secundarias, podrá ejercer sus derechos conforme al apartado VIII.

b) Clientes

Los datos proporcionados por Clientes serán utilizados para ejecutar actividades de cobranza extrajudicial, generar y administrar bases de datos de deudores, gestionar expedientes, realizar análisis internos, mantener comunicación operativa, efectuar investigaciones, localizaciones y realizar las gestiones necesarias derivadas de la relación contractual o comercial. La información podrá comunicarse a terceros relacionados con la obligación original, así como a personal operativo o administrativo de COLEKTIA. Adicionalmente podrán utilizarse para identificación de clientes o deudores, fines publicitarios o actividades administrativas internas, salvo que el Cliente manifieste su negativa conforme al apartado VIII.

c) Trabajadores

Los datos personales de los Trabajadores serán utilizados para administrar la relación laboral, procesos de selección, contratación, capacitación, cumplimiento normativo, seguridad interna y comunicación institucional.

d) Proveedores

Los datos personales de Proveedores serán utilizados para la gestión de expedientes administrativos, validación operativa, control comercial, facturación y cumplimiento del vínculo de prestación de servicios.

II. DATOS PERSONALES QUE SE RECABAN

COLEKTIA podrá obtener datos personales mediante formularios físicos o digitales, llamadas telefónicas, WhatsApp, SMS, correo electrónico, interacciones web o cualquier otro medio de contacto.

  • Usuarios pueden proporcionar nombre, correo electrónico, teléfono, empresa, país y datos de contacto.
  • Clientes pueden proporcionar nombre, domicilio, Cédula de Ciudadanía, correo electrónico, teléfono, estado civil, antecedentes financieros y comerciales, información del crédito y datos de deudores.
  • Trabajadores pueden proporcionar nombre, Cédula de Ciudadanía, domicilio, datos de contacto, antecedentes laborales, datos administrativos y bancarios.
  • Proveedores pueden proporcionar nombre, razón social, NIT, domicilio, datos de facturación y contacto.

Los datos de deudores proporcionados por Clientes serán tratados exclusivamente para fines de cobranza extrajudicial, conforme a la Ley 1581 de 2012, su normativa reglamentaria y la relación jurídica existente entre Cliente y deudor.

III. REDES SOCIALES

El tratamiento de datos derivados de interacciones con redes sociales oficiales se rige por los términos y políticas propias de cada plataforma. COLEKTIA no controla los datos que estas plataformas recopilen directamente del Usuario.

IV. MEDIDAS DE PROTECCIÓN Y SEGURIDAD

COLEKTIA tratará los datos personales conforme a los principios de legalidad, finalidad, libertad, veracidad, transparencia, acceso, circulación restringida, seguridad y confidencialidad establecidos en la legislación colombiana. Asimismo, implementará medidas administrativas, técnicas y físicas consistentes con los estándares ISO 27001 e ISO 9001, incluyendo controles de acceso, cifrado de información, protocolos de seguridad, monitoreo de incidentes, trazabilidad, auditorías, continuidad operativa y planes de recuperación.

V. TRANSFERENCIAS Y TRANSMISIONES DE DATOS

Los datos personales podrán ser transferidos a entidades relacionadas del Grupo COLEKTIA dentro y fuera de Colombia; transmitidos a proveedores tecnológicos con quienes COLEKTIA tenga acuerdos de encargo de tratamiento; entregados a Clientes que requieran información de deudores para gestiones de cobro o acciones judiciales; comunicados a autoridades administrativas o judiciales conforme a ley; compartidos con terceros relacionados con la obligación original del Cliente.
Toda transferencia o transmisión se realizará conforme a la normativa colombiana vigente y solo para las finalidades previstas en este Aviso.

VI. USO DE COOKIES Y TECNOLOGÍAS SIMILARES

El sitio web de COLEKTIA utiliza cookies, pixel tags y tecnologías similares para mejorar la experiencia del Usuario, realizar análisis estadísticos y ofrecer servicios personalizados. El Usuario podrá restringir o eliminar cookies desde la configuración de su navegador, reconociendo que esto podría afectar algunas funcionalidades del sitio web.

VII. OPCIONES Y MEDIOS PARA LIMITAR EL USO O DIVULGACIÓN

Los Titulares podrán solicitar la limitación del uso o divulgación de sus datos, incluyendo restricciones para finalidades secundarias o inclusión en listas internas de exclusión, mediante los mecanismos previstos en el apartado VIII.

VIII. DERECHOS DE LOS TITULARES (HABEAS DATA)

Los Titulares podrán ejercer sus derechos de acceso, actualización, rectificación, supresión y revocatoria de la autorización, así como presentar reclamos relacionados con el uso de sus datos personales, mediante solicitud enviada a privacidad@colektia.com. La solicitud deberá incluir nombre completo, número de identificación, medio de contacto, descripción clara del derecho ejercido y documentos que acrediten identidad.

COLEKTIA responderá dentro de los plazos establecidos por la normativa colombiana. Si el Titular considera vulnerados sus derechos, podrá presentar reclamación ante la Superintendencia de Industria y Comercio (SIC).

IX. MODIFICACIONES AL AVISO

COLEKTIA podrá modificar este Aviso para reflejar cambios legales, tecnológicos u operativos. Las modificaciones serán publicadas en el sitio web oficial y entrarán en vigor desde su publicación.

X. CONSENTIMIENTO

El Titular declara haber leído y comprendido este Aviso. La entrega de datos personales, el uso de los servicios de COLEKTIA o la comunicación con la empresa constituye autorización para el tratamiento descrito, conforme a la legislación colombiana vigente.
